By accessing the Olmos Hardscaping website at olmoshardscaping.com or by requesting or using any of our services — including hardscape, landscape, tree service, lawn care, land clearing, fencing, and related outdoor work — you agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, please do not use our website or services.

1. Agreement to Terms

These Terms & Conditions govern your use of our website and the services provided by Olmos Hardscaping LLC ("Olmos Hardscaping," "we," "us," or "our"), a family-owned company serving Lenoir, Boone, Blowing Rock, Hickory, Morganton, Taylorsville, and surrounding areas of the North Carolina High Country. Any signed estimate, proposal, or work agreement between you and Olmos Hardscaping is incorporated into and read together with these terms.

2. Our Services

Olmos Hardscaping provides outdoor improvement and property services, including but not limited to:

• Hardscape — paver patios, walkways, retaining walls, and stone work.
• Landscape — design, planting, mulch beds, shrubs, sod, and lawn transformations.
• Tree service — trimming, pruning, and removal.
• Lawn care, land clearing, gutter cleaning, fencing, and decks & structures.

Availability, scope, materials, and pricing may vary by project and are subject to change. The specific work to be performed is defined in the written estimate or proposal provided for your project.

3. Estimates & Pricing

We provide free, no-obligation estimates following an on-site visit or review of project details. Estimates are based on the conditions, measurements, and information available at the time and are valid for 30 days unless otherwise stated. Unforeseen site conditions — such as rock, poor soil, drainage issues, buried debris, or root systems discovered during work — may affect the final scope and price, which will be communicated before additional work proceeds.

4. Scheduling, Property Access & Site Conditions

By scheduling work, you agree to provide safe and reasonable access to the work area and to the following:

• You are responsible for confirming property lines and obtaining any permits, HOA approvals, or authorizations required for the work, unless we have agreed in writing to handle them.
• Underground utility locating: Public utilities will be marked through North Carolina 811 prior to digging. However, you are responsible for identifying private lines and installations — including irrigation/sprinkler systems, low-voltage and landscape lighting, invisible pet fences, private water, gas, or electrical lines, septic systems, and drainage — as these are not located by 811. Olmos Hardscaping is not liable for damage to unmarked or improperly marked private installations.
• We are not responsible for pre-existing conditions, including but not limited to drainage problems, grading, settling, prior workmanship by others, or hidden defects beneath the surface.

5. Change Orders & Additional Work

Any change to the agreed scope of work — including additions, substitutions, or work uncovered during the project — must be agreed upon before it is performed and may result in additional charges and adjusted timelines. Verbal requests for changes may be confirmed in writing or by text/email for both parties' records.

6. Workmanship & Warranties

We stand behind our work. Unless a different period is stated in your written agreement:

• Workmanship on hardscape installations is warranted against defects in installation for one (1) year from completion.
• Materials (pavers, stone, fencing, etc.) carry only the warranty provided by their manufacturer, if any.
• Plants, sod, and seed are living materials. Because their survival depends on watering, weather, and ongoing maintenance after installation, they are not guaranteed unless a specific plant warranty is stated in writing and proper care instructions are followed.

Warranties do not cover damage caused by weather, storms, flooding, drought, freeze/thaw cycles, natural settling or shifting of soil, improper maintenance, neglect, vehicle or equipment traffic, animals, or work or alterations performed by anyone other than Olmos Hardscaping.

7. Tree & Land Clearing Services

Tree work and land clearing involve inherent risks. While we take every reasonable precaution, you acknowledge that:

• Removal, trimming, and clearing may cause incidental impact to surrounding lawn, beds, or surfaces despite our care.
• Unless expressly included in your estimate, stump grinding, hauling of debris, and full cleanup may be separate services.
• We do not guarantee against future regrowth, sprouting, or root activity, and we are not responsible for the condition of trees or limbs weakened by disease, rot, storms, or prior damage.

8. Deposits & Payment

For many projects a deposit is required to schedule work and order materials; deposits may be non-refundable once materials have been ordered or work has begun. The remaining balance is due upon completion unless other arrangements are made in writing. We accept cash, major credit/debit cards, and other methods as agreed. Past-due balances may be subject to collection, and we reserve the right to place a lien on the property as permitted by North Carolina law for unpaid work.

9. Cancellations & Weather Delays

Outdoor work is weather-dependent. We may reschedule for rain, frozen ground, unsafe conditions, or other circumstances beyond our control, and we are not liable for delays caused by such events. If you need to cancel or reschedule, please give us as much notice as possible; cancellations after materials have been ordered may incur costs.

10. Promotional Offers

From time to time we may offer promotions or discounts. Unless otherwise stated, offers are limited to one per household, are non-transferable, cannot be combined with other offers, have no cash value, and may be modified or discontinued at any time without prior notice.

11. SMS & Communications

If you provide your mobile phone number — through our website, a chat widget, a form, or directly to our team — you are providing express consent to receive SMS text messages from Olmos Hardscaping related to your inquiry, estimate, appointment reminders, project updates, and occasional offers.

• Frequency: Message frequency varies based on your interaction with us.
• Cost: Standard message and data rates may apply, depending on your mobile carrier and plan.
• Opt-out: Reply STOP at any time to stop receiving messages. After you reply STOP, we will not send further SMS messages unless you opt back in.

• No purchase necessary: Consent to receive SMS messages is not a condition of any purchase or service.

Mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors that support our services, such as customer service or message delivery providers, is permitted. All other use case categories exclude text-messaging originator opt-in data and consent; this information will not be shared with any third parties.

12. Limitation of Liability

To the maximum extent permitted by applicable law, Olmos Hardscaping and its owners, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of our services or website, regardless of the cause of action. Our total liability for any claim shall not exceed the amount you paid for the specific service giving rise to the claim.

13. Indemnification

You agree to indemnify and hold harmless Olmos Hardscaping, its owners, employees, and agents from any claims, losses, damages, liabilities, and expenses (including reasonable attorney's fees) arising from your use of our services or any violation of these Terms & Conditions.

14. Governing Law

These Terms & Conditions are governed by and construed in accordance with the laws of the State of North Carolina, without regard to conflict-of-law principles. Any disputes arising under these terms shall be resolved in the courts located in Caldwell County, North Carolina.

15. Changes to These Terms

We reserve the right to update or modify these Terms & Conditions at any time. Changes become effective immediately upon posting to this page. Your continued use of our services or website after any changes constitutes acceptance of the updated terms. We encourage you to review this page periodically.
